1. Introduction

B&R Portable Restrooms & Services (“B&R,” “we,” “our,” or “us”) respects your privacy and is committed to handling your personal information responsibly. This Privacy Policy (“Policy”) explains how we collect, use, disclose, and safeguard information when you visit our website (the “Site”), request a quote, place an order, or otherwise interact with us online.

B&R has been providing portable restrooms of all types to central Indiana since 1998. With years of experience, we are a knowledgeable and reliable portable toilet rental provider. By accessing or using the Site, you acknowledge that you have read and understood this Policy. If you do not agree with our practices, please do not use the Site or submit information to us.

2. Scope of This Policy

  • Information collected offline or through separate service or rental agreements;
  • Information handled under a separate agreement or notice provided at the point of collection; or
  • Third-party websites or services that may link to or from the Site, which are governed by their own privacy policies (see Section 6).

3.2 Information Collected Automatically

When you visit the Site, we and our service providers may automatically collect certain technical and usage information through cookies and similar technologies, including your IP address, approximate location, device and browser type, pages viewed, links clicked, referring/exit URLs, and dates and times of your visits.

3.3 Information from Third Parties

We may receive limited information from third-party sources, such as referral partners or service providers that support our business.

4. How We Use Your Information

We use the information we collect to:

(a) Respond to your inquiries and quote requests;

(b) Process, fulfill, and manage your portable restroom rentals and related services;

(c) Process payments and manage billing;

(d) Schedule delivery, servicing, and pickup of units;

5. How We Share Your Information

We do not sell your personal information. We also do not rent personal information, and we do not disclose personal information to third parties for their own direct marketing purposes without providing notice and, where required, choice. We may share information in the following circumstances:

  • Service Providers – with trusted third parties that perform functions on our behalf, such as website hosting, analytics, payment processing, email/communications, scheduling, and IT support, who are authorized to use your information only as needed to provide services to us;
  • Legal and Compliance – where we believe in good faith that disclosure is necessary to comply with applicable law, legal process, or governmental request; to enforce our agreements; to prevent fraud or security issues; or to protect the rights, property, or safety of B&R, our customers, or others;

  • With Your Consent – for any other purpose disclosed to you with your consent.

We may also share aggregated or de-identified information that does not identify any individual, without restriction.

6. Third-Party Services and Payment Processing

We use third-party services in connection with the operation of the Site, including for analytics, hosting, and payment processing. Payment processing is performed by Nuvasoft. When you make a payment through the Site, your payment information is collected and processed by Nuvasoft, and its collection and use of your information is governed by Nuvasoft’s own privacy policy, not this Policy. We encourage you to review Nuvasoft’s privacy policy to understand how your information is handled.

More generally, the Site may contain links to, or integrations with, third-party websites and services. We are not responsible for the privacy practices or content of those third parties, and we encourage you to review their privacy policies before providing any personal information.

7. Cookies and Similar Technologies

The Site uses cookies and similar technologies to enable core functionality, remember your preferences, analyze how the Site is used, and improve performance. Cookies are small text files placed on your device when you visit a website, and we may also use related technologies such as pixels and tags.

7.1 Cookie Banner and Managing Your Preferences

When you first visit the Site, you may be presented with a cookie consent banner that explains our use of cookies and allows you to make choices about the categories of cookies we use. Through the banner and our cookie preference tool, you can accept all cookies, reject non-essential cookies, or customize your choices by category (such as strictly necessary, functional/preference, and analytics/performance cookies). Strictly necessary cookies are required for the Site to operate and cannot be disabled.

You can revisit and change your selections at any time by clicking the “Cookie Preferences” (or “Cookie Settings”) link located in the footer of the Site. You may also manage or delete cookies through your browser settings. Because your preferences are stored in a cookie on the device and browser you are using, you may need to set them again if you clear your cookies, use a different device, or switch browsers. Please note that disabling certain cookies may affect the functionality or performance of the Site.

7.2 Do Not Track

Because there is no uniform industry standard for browser “Do Not Track” signals, the Site does not currently respond to them.

8. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. Any transmission of information is at your own risk.

9. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Policy, including to provide services, process payments, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we securely delete, destroy, or de-identify it.

10. Indiana State Privacy Rights

The Indiana Consumer Data Protection Act (“INCDPA”) provides Indiana residents with certain rights regarding their personal data, subject to the exceptions and limitations set forth in that law. If you are an Indiana resident, you may have the right to:

  • Right to Know / Access – confirm whether we are processing your personal data and access that personal data;
  • Right to Correct – correct inaccuracies in your personal data, taking into account the nature of the data and the purposes of processing;
  • Right to Delete – delete personal data provided by or obtained about you; and
  • Right to Data Portability (Right to Transfer) – obtain a copy of your personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance, where the processing is carried out by automated means.

Indiana residents also have the right not to be discriminated against for exercising these rights and, where applicable, the right to appeal our decision regarding a request.

10.1 How to Exercise Your Rights

To submit a request, please contact us at [PRIVACY CONTACT EMAIL] or using the details in Section 12. We will take reasonable steps to verify your identity before responding, which may involve confirming information we already maintain. You may use an authorized agent to submit a request on your behalf, subject to verification. We will respond within the timeframes required by applicable law.

10.2 Appeals

If we decline to act on your request, you may appeal our decision by contacting us at [PRIVACY CONTACT EMAIL] with the subject line “Privacy Rights Appeal.” If your appeal is denied, you may contact the Indiana Attorney General to submit a complaint.

11. Children’s Privacy

The Site is intended for a general adult and business audience and is not directed to children. We do not knowingly collect personal information from children in a manner inconsistent with applicable law. If you believe a child has provided us with personal information, please contact us at [PRIVACY CONTACT EMAIL] and we will take appropriate steps to delete it.

12. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we make changes, we will revise the “Last Updated” date above and, where appropriate, provide additional notice. We encourage you to review this Policy periodically.
